When families realize that an elderly or incapacitated relative can no longer live safely and Attorneys Jody Cohen Press and 
Steven Press independently, it's important that they take action to protect the individual.  This can be achieved by petitioning a court for a guardianship.  Having handled a variety of estate planning and elder law issues for twenty-five years, we are dedicated to helping families and individuals take care of those family members who can no longer effectively manage and care for themselves.

Many clients that come to us are the son, daughter, sibling, niece, nephew or other relative of the individual who is in need of protection. We work closely with family members to ensure that the proper information is gathered to thoroughly prepare the detailed paperwork required by the court.

In addition to helping families that are caring for elderly individuals, we also help parents of disabled children who are about to reach the age of majority. Once a child turns 18, parents could have a difficult time obtaining necessary medical information due to increasingly strict HIPAA laws. By establishing a guardianship, parents can retain the control they need over their disabled children so they can continue to actively participate in their medical care, day-to-day care and other decision-making.

Though we handle contested guardianships where family members are uncertain regarding who will monitor and manage care for the individual, our goal is to reach a solution that is amicable and ensures the individual's best interest. We help families understand what needs to be done in order to get mom, dad or other elderly family member the care he or she needs.

Conservatorship

While a guardianship involves the physical care of an incapacitated person, a conservatorship protects that person's financial assets. Typically, a guardianship and conservatorship can be created at the same time. When you speak with us, we can assess your situation and can explain the procedure for obtaining a conservatorship.
